Ninth Circuit denies rehearing petition, upholds CRA’s victory in suit against the City of Berkeley’s Natural Gas Infrastructure Ban
In a significant triumph for California's restaurant industry and The CRA, the 9th Circuit Court of Appeals has affirmed a ruling that declares the City of Berkeley's ban on natural gas infrastructure preempted by federal law. Unless appealed to the Supreme Court of the United States, this decision will nullify and prevent local governments in California and other states within the 9th Circuit from imposing bans on natural gas infrastructure in new construction.
